山东理工大学硕士学位论文摘 山东理工大学硕士学位论文 摘 要 万方数据 万方数据 摘 要 内部运行机制是否顺畅，关系到基层人民法院能否充分有效地发挥职能，是基层 人民法院工作能否健康发展的重要因素。持续了近十六年的司法体制改革，对人民法 院的职能定位及科学管理都产生了重要影响，但目前基层人民法院内部管理体制仍然 存在诸多问题，主要表现在审判权运行不畅、审判管理不科学、案多人少矛盾突出、 执行难痼疾难除、司法腐败问题显现等方面。这些问题制约着基层人民法院基本职能 的发挥，因此，进一步深化基层人民法院工作机制改革势在必行。 文章立足基层人民法院工作实际，对基层人民法院科学管理研究成果进行了梳 理，并对作者所在基层人民法院表现出的内部管理问题进行调研与总结，将理论与实 践进行比较研究，分析产生问题的原因，并有针对性地提出进一步完善基层法院运行 机制的可行性建议，进而自下而上地反哺基层人民法院内部管理体系的科学化与合理 化。 基层人民法院内部管理体系是一个庞大而复杂的系统，其完善需要成熟的制度体 系加以实现与保障。文章主要从审判权运行机制、审判流程管理机制、多元化矛盾化 解机制、参与社会管理创新机制、人事管理机制、法院文化繁荣机制等六个方面展开 论述。 关键词：司法改革；基层法院；科学管理 I 山东理工大学硕士学位论文Ab 山东理工大学硕士学位论文 Abstract Abstract Whether the internal operation mechanism is smooth, is related to whether the basic peoples court can give full play to the functions of the work,and is an important factor to the healthy development of the basic peoples courts. The reform of the judicial system lasted for nearly sixteen years, and had an important influence on the function orientation and scientific management of the peoples court, but the internal management system of the basic peoples courts still exists many problems, mainly in the judicial trial running sluggish, unscientific management, case a little contradiction, difficult execution are insurmountable judicial corruption problems appeared, etc.. These problems restrict basic functions of the grassroots peoples court.Therefore, further deepening the reform of the working mechanism of the grassroots peoples court is imperative. On the basis of the basic peoples court practice and the achievements in the research of the basic peoples court scientific management reviews, the article carries on the investigation and study about the internal management of the grassroots peoples court,combines the theory and practice, analyzes the causes of the problems, and puts forward some feasible suggestions to further improve the grass-roots court operation mechanism, then makes the internal management system of the grassroots peoples court more scientific and reasonable
