Coase thought the conclusion that it is desirable that the railway should be made liable for the damage it causes is wrong. The question at issue is not whether it is desirable to run an additional train or to install smoke-preventing devices; the question is whether it is desirable to have a system in which the railway has to compensate those who suffer damage from the fires which it causes or one in which the railway does not have to compensate them. ; 庇古指出两点: 1、首先政府需改变火车有权损害农田的 “自然状态” 2、火车应该给农民赔偿 科斯认为:1、The reason why compensation was not paid must have been that the railway had statutory authority to run steam engines. In the real world, Pigou’s example could only exist as a result of a deliberate choice of the legislature.
