中文提要地役权是大陆法系民法及英美法系财产法上均设立的一项重要制度，地役权制度能 中文提要 地役权是大陆法系民法及英美法系财产法上均设立的一项重要制度，地役权制度能 够提高土地利用价值，最大限度地发挥土地的效能。本文采用历史考察、比较考察及实 证分析等方法，在广泛深入归纳分析大陆法系和英美法系关于地役权制度的理论研究和 立法实践的基础上，对地役权制度进行了系统深入地研究，并结合我国的立法状况，对 地役权制度的立法和适用方面提出自己独到的建议。 本文正文共三部分： 第一部分，地役权制度的概述。该部分简要论述了地役权制度的起源，着重对大陆 法系和英美法系的地役权制度的立法内容和立法例进行了比较研究，探讨了二者在制度 内容上的共同性及立法例的差异。同时阐述了地役权的概念、特征、类型和价值功能， 有助于进一步认清地役权的本质。 第二部分，地役权与相关权利之分析，分析了地役权与所有权、人役权及相邻关系 相比较所具有的独特法律属性。着重介绍地役权与相邻权的区别，提出了新的见解：地 役权有着相邻权不可替代的功能和独特而重要的适用空间。同时，分析了地役权制度的 优越性和排除相邻关系的价值取向。 第三部分，关于我国地役权立法及适用的思考。该部分首先介绍了我国地役权制度 的历史演进；其次就地役权条文，探讨我国地役权的主体、客体及适用范围上存在的不 足之处；再次从地役权的取得方式和消灭事由方面查找立法上存在的漏洞；最后，就地 役权上供役地设施所有权的归属进行进一步探讨。 关键词：物权法 地役权 立法考察 适用建议 AbstractThe Abstract The servitude originated is an important system which is set up both on the civil law of the Civil law system and the property law of the Common-- Law system．The Servitude system can enhance the Land use value，and to exert the maximum effectiveness of land． Using the method of the history research， the comparative study and the empirical analysis and SO on，this article makes a thorough and systematic study to the servitude system on the basis of the widespread and thoroughly concluding and the analysi s of the theory study and the legislative practice of the servitude system in the Civil law system and the Common--Law system．At the same time，unifying the Chinese actual condition， it makes the original and unique proposal to the legislative structure and the legislative content of the servitude system． This main text of the article altogether composes three parts． The first part：essential theory of the Servitude system．This part briefly elaborates the developing process of the Servitude system,and researches the various countries’ Servitude system．This part conducts the comparison research of the contents and the legal regulation of the Servitude system between the Civil 1aw and the Common--Law system，and also discusses the common traits in the system contents of theⅡL The second part：the Servitude sys
