AbstractWith Abstract With the development of the socialist market economy,a lot of enterprises have been established and transactions in the market involve a larger and larger field.As a result,conflicts belween trademark rigbts and store rights tend to rise gradually in practice. All kinds of conflicts between trademark rights and store rights have brought about serious consequences.They have caused economic disorder and go against shaping fair and orderly competitive environment.But our legal system does not regulate these rights completely or systematically.Consequently,the obligee’s righ£s cannot be protected,market subjects arc confused and their rights are weakened.This paper investigates ways to settle the conflicts between laademark rights and store rights and protect the benefits of relevant obligees.Part one of this paper briefly introduces the types of these conflicts and points out incomplete laws,defective authorization institute and the benefit-approaching features ofbusiness subject are the major c.all∞S ofthese conflicts.Part two analyses other countries’relevant legislation with the aim to u∞international advanced l卿mmb【Ig experience鹊reference to improve 0111legislation.Part three mainly examines the coordination and settlement of conflicts between trademark rights and store rights so鹪to protect the benefits of relevant obligees to its best. Key words:Trademark fight;Store right;Conflicts of rights;Coordination and settlement Ⅱ 引 引 言 近几年,商标权与商号权的权利冲突问题逐年增多,引起人们的广泛关注。 比如大家所熟知的北京市王致和腐乳厂诉北京顺义县致和腐乳厂商标侵权案,台 湾蜜雪儿开发有限公司状告美国独资企业北京蜜雪儿服饰有限公司案,沈阳市小 土豆餐饮有限公司诉北京市东北小土豆餐饮有限公司案,这些众多的案例充分暴 露了我国存在的商标与商号的权利冲突以及规范上的漏洞。 而且随着市场经济的发展,此类现象里上升态势。可以预想,如果此类纠纷 不能得到妥善处理与有效控制,不能从根本上、制度上加以规范、协调和解决, 不仅直接损及相关权利人的利益,而且将会形成示范效应,导致更多的仿效者, 引发更多的纠纷,破坏公平竞争与诚信经营的市场秩序,从而不利于我国市场经 济体制的确立与完善,也不利于我国融人全球化的经济竞争。由此可见,解决商 标权与商号权的权利冲突问题,是摆在我们面前的非常现实而紧迫的问题,也是 知识产权学界应予着力探讨的重大课题。 第一部分商标权与商号权冲突的表现形式及成因 第一部分商标权与商号权冲突的表现形式及成因 一、商标权与商号权冲突的表现形式 (一)商标权与商号权的关系 1、商标与商号的含义与异同 商标是商品的生产者或经营者对其生产、制造、加工,拣选或者经销的
