I I 摘 要 摘 要 随着互联网技术的飞速发展，互联网技术在人民的生活领域被广泛应用，给人们的 工作生活带了许多便利，但与此同时也带来了在网络环境下人们隐私权被泄露的可能 性。网络环境下的隐私侵权不仅会给被侵权人带来人格权的伤害，也有可能会给被侵权 人带来财产损失。因此，世界各国都在努力通过立法或者通过网络服务商的行业自律等 方式加强对本国网络环境下的隐私权保护。目前我国对网络环境下的隐私权保护存在着 立法规定不完善、行业自律意识不高、网络用户自我保护意识不够等问题。对比美国以 行业自律为主、欧盟以立法为主的两种保护模式，我国应通过完善宪法保障、完善部门 法、加强行业自律等方式建立起适合我国国情的以法律规制为主、行业自律为辅的网络 环境下的隐私权保护模式。 关键词 隐私 隐私权 安全港协议 II II Abstract Abstract With the rapid development of Internet technology, The Internet technology is widely used in the field of peoples life. Though these developments should bring many benefits, the security of rights of privacy under the network environment is expected to become a problem. An invasion of privacy will not only bring damage to the personality right , but also bring enormous loss to the infringed.So all countries in the world try to strengthen the protection of privacy through legislation or self-discipline mode of the internet service provider. At present ,there are many problems in our country for the protection of privacy under the network environment, such as: the legislation leaves a lot to be desired, the internet service providers have low levels of the self-discipline consciousness ,consumers should strengthen self-protection consciousness. There are two protection modes in the industry : centering on the self-discipline in American and on legislation in EU. Accordingly, Through improving constitutional protection and the department law and strengthening industry self-discipline, the privacy protection mode in our country should mainly regulated by law and the industry self-discipline as the supplement under the network environment. which is suitable for the national conditions of our country .
