PAGE PAGE IV 论男子性权利的刑法保护 的概念过于狭窄。实践中也有许多不合理的做法，比如把侵犯男子性权利的行为 按照伤害罪、侮辱罪、虐待罪和行政处罚案件来处理，由于在行为的性质、主体 构成、主观目的等方面的表现都有所差别，这种处理显然是不合理的，需要规范 和纠正。 第五部分，也是文章的最后一部分，主要是针对文章中前四部分对问题的提 出和分析进行一个全面的总结，并且提出相应的解决思路：1.可以考虑修改强奸 罪的规定，把强奸罪的对象改为“他人”，取消该罪主体的限制；2.重新界定“性 交”，把口交、肛交和异物插入等形式纳入性交的范围以适应社会的发展；3.规 定男子在被性侵犯时同样具有正当防卫的权利，这样可以更好的保护男子的性权 利不受侵犯；4.把成年的男子纳入强制猥亵侮辱罪的保护对象，弥补该罪成年男 子主体的空白。 本人理论水平有限，但求尽心尽力，希望这篇文章能对我国男子性权力刑法 保护有所帮助。 关键词：性权利；性侵犯；强奸罪；男子性权利；平等保护；刑法保护 Abstract From the beginning of human history, sexual rights, as one of basic physiological needs and instincts, has been catching a lot of attention from society, not only the society which is controlled by the custom but also the one managed by the law. However, from the day when sexual rights included in the scope of legal protection, it is also obvious that the law paid much more attention to women’s sexual rights. Because thousands of years of Chinese traditional culture, the difference in social status and innate physiological conditions between women and men as well as the views and attitude about sexual behavior, we have to admit that only women’s sexual rights have been paid more attention is in line with the specific history conditions. It’s necessary and reasonable. However, with the development of society, the social and historical conditions have changed a lot. Under the influence of gradually changing sexual concept, the notion that men and women are equal, the expansion of homosexual population, the increase of social pressure, and even some serious psychological distortion, at the same time, the whole society is becoming more tolerant of the strong personality, it seems more likely that the male sexual rights are infringed by homosexual, heterosexual or some particular population (e.g. transsexual, double sexual or asexual).
