论侦查讯问程序中的问题与对策 学生姓名：出甜 学号：20090010740 系别：一支队专业：侦查 指导老师：邹荣合职称：副教授 摘要：侦查讯问，是指公安等侦查机关的侦查人员为了查明案件的全部事实 真相，依法对犯罪嫌疑人进行审讯和诘问，以获取真实供述或辩解，最后决定是 否移送起诉或作其他处理的侦查活动。是侦查人员为获取犯罪嫌疑人口供并籍此 来查明或印证“犯罪事实”而进行的一种证据收集活动。由侦查讯问所形成的讯 问笔录在证据种类中属于言词证据，与其它证据收集活动相比，侦查讯问活动对 于侦查破案具有至关重要的作用。正因为它的重要性，在现实侦查过程中，为获 取犯罪嫌疑人的口供，侦查讯问几乎无时不面临着被异化为包括刑讯逼供在内的 非法取证行为的问题。我国侦查讯问程序中的讯问过程存在的强制性和封闭性， 使犯罪嫌疑人几乎被完全控制在侦查人员的手中，其权利根本无法得到保障。因 此改变“重实体轻程序”的观念，正确行使侦查讯问权，保证程序合法，确保那 些处于被讯问地位的犯罪嫌疑人拥有一些最基本的防御权，从而能够成为侦查讯 问程序的主体，就成为我国侦查讯问制度改革的主要课题。 关键字：侦查讯问；侦查人员；犯罪嫌疑人 Abstract: Police interrogation, refers to the investigation organ such as the in vestigators to find out all the facts, the case in accord a nee with the crimi nal suspect for trial and heckle, to get real statement or excuses and finally decided whether to prosecute or other treatment investigation activities.
