PAGE PAGE III 亲属间的拒证特权研究 摘 要 我国的亲属拒证权的来源历史非常悠久，在慢慢的发展当中在不断的完善，总体来说我国的亲属拒证权这一规定和西方国家虽有有着很大的差别，但是也是符合我国的国情，同时也是我国尊重还有保证人权在刑事诉讼领域的非常重要的体现。在现在的社会中具有非常重要的价值和存在的重要的意义，但经过阅读相关的研究文献还要查阅关于亲属拒证权的相关权利，发现是我国亲属间拒证权还存在着很多的不足和缺陷，这其中主要有使用的主体，适用的内容，适用的程序等等的，所以急需要解决相关的问题。本文从亲属间拒证权的相关概念出发，探讨现目前我国亲属间拒证权现状，从中找到存在的问题和不足，并依次提出相应的优化建议。 关键词：亲属间 拒证权 优化  ABSTRACT The source of the right of refusing to testify of relatives in China has a very long history, which is constantly improving in the slow development.
