PAGE 12 对优化民事案件繁简分流划分标准的思考 摘要：随着社会矛盾逐渐增多，大量诉讼案件亟待解决，而案多人少的矛盾也日益突出。为此，最高人民法院颁布《关于进一步推进案件繁简分流优化司法资源配置的若干意见》，该《意见》共有二十二条法律法规，涵盖到相关民事、刑事处理以及行政审判三大主要方面，包括多个诉讼环节，例如备案，分庭，送达，法庭聆讯和撰写判决文件等，并且要求采取若干精简措施来实施案件转移，推进对案件档案的筛选和转移以及尽量发挥审前会议的职能。 但是《意见》有关民商事案件繁简分流的规定依然仅仅是基础性的、概括性的，在高效实现繁简分流这一路径上，仍然存在许多不足之处，可操作性并不强，为此，应当充分总结我国各级法院在实施繁简分流这一制度时积累的经验，找到分流程序每一个环节上存在的不足，通过完善繁简分流标准、建立专门的小组、做好裁判文书分流、健全审判程序辅助制度等，以此建构起完整和科学的繁简分流制度，从而为缓解我国基层法院“案件较多、人员不足”的矛盾、大力提高法院的审理、判决速度和效果等方面提供政策制度上的支持。 关键词：繁简分流；简易程序；民事送达 Abstract With the increasing of social contradictions, a large number of litigation cases need to be solved urgently, and the contradiction of fewer cases is increasingly prominent.
