网络言论自由的法律保障——以“方崔案”为案例分析 摘要：随着互联网的普及，人类己经进入了大数据和自媒体时代。在互联网社会屮，侮 个人都是平等的发生者，这意味着个人的言论自山得到了极人地解放和发挥因此网络言论有利 于打破传统媒体的垄断，促进文化传播，舒缓社会孑盾。然而任何自由都不是没冇界限的，网 络言论自111不仅需要法律保护，更需要法律规制。相比较传统的言论自由权，山于互联网的匿 名性、无中心化、反馈即时件等特征。而网络环境的自由开放性，任何人都可以匿名方式在网 络上发布信息，而很难找到这些非法、有害信息的发送者，管理机构对其他网尺调阅这吐信息 也难以控制。因此，如何改善网络信息传播屮的失控与混乱状况，最大限度地降低网络带来的 负面影响，已成为摆在各国政府面前的一个I-分紧迫的问题。完善网络言论自由的法律保障， 应当从网民守法意识、法律法规完善、专业队伍建设、自律标准的建立、主流媒体的打造等方 而进行着力。 关键词：言论自由网络法律保障 Abstract: with the popularity of the Internet, human beings have entered the era of big data and media. In the Internet society, eveiyone is equal to happen, which means the personal freedom of speech has been greatly liberated and play so the speech in the Internet can help to break the monopoly of traditional media, promote the dissemination of culture, to relieve social contradictions. But any freedom is not without limits, the freedom of the Internet is not only need legal protection, but also need legal regulation? Compared with the traditional right of freedom of speech, because of the anonymity of the Internet, no center, feedback and other features. And network environment is free and open, and anyone can anonymously to publish information on the Internet, and it is veiy difficult to find these illegal and harmful information to the sender, the management mechanism of other Internet users access to these information is difficult to control. Therefore, how to improve the control and chaos in the network information dissemination, to reduce the negative impact of the network, has become a veiy urgent problem in front of the governments of all countries. To improve the legal protection of freedom of speech in the network, should be from the Internet users awareness, improve the laws and regulations, professional team building, the establishment of self regulatory standards, the mainstream media to build and so on.
