艺人与娱乐公司之间签订的不平等合同条款问题研究 摘 要 近些年来，随着娱乐市场的不断发展，越来越多的新人走入这个行业。作为一个刚踏入娱乐行业的新人，缺乏人脉与资源，很难在竞争激烈的市场中博出一片天地。因此，大部分新人会选择与经纪公司以签订经纪合同的形式为自己赢得竞争机会。这就导致艺人与娱乐公司的纠纷案件数量逐年上升，艺人与娱乐公司间的矛盾越来越多。在这些纠纷中，娱乐公司为原告的居多，与其相反作为弱势群体的艺人身为被告常常需要支付高额违约金。演艺合同纠纷常常会与艺人与娱乐公司签订的合同存在大量不平等条款相关联。且我国演艺经纪方面的立法尚不健全，处于弱势地位的艺人如何保护自己的权利以及如何规范演艺市场都是我们进行研究的意义所在。 关键词：演艺经纪合同 演艺市场法律机制 合同法 不平等合同条款 艺人 Research on the unequal contract terms between artists and entertainment companies Abstract Last several years, with the continuous development of entertainment market, a growing number of new people enter the industry.
