PAGE PAGE 16 地役权的传统定义 摘要 地役权的传统定义是指为自己土地的便利而利用他人土地的权利，承担地役权的土地称为供役地，利用地役权的土地称为需役地。 地役权制度是古罗马法当中率先确立的一项法律制度。地役权制度的产生是为了促进物尽其用，满足人们对土地的利用。从民法的历史沿革来看，最早的他物权制度莫过于地役权了。 地役权的诞生对提高社会整体效益，促进社会经济发展起到了重要作用。因而，被世界各国所吸收为自己法律体系当中的一部分。2007年，地役权制度被写入我国的《物权法》当中，成为了我国法律体系的一部分。其区别于我国《民法通则》中的相邻关系，具有独特的立法价值，同时，地役权作为物权法的一部分，允许了当事人意定，也是对物权法定原则的变通。虽然地役权在我国从无到有的发展起来，但是其任然有有待完善和进步的方面。 因此，为了使地役权这一古老制度在我国现代社会中充分发挥其生机与活力，必须对地役权制度进行细致的剖析，借鉴各国先进的立法经验，以及其在学理上的研究不断发展和完善我国的地役权制度。 关键词：地役权;物权法;物权法定;完善 Abstract The traditional definition of the right to use the land is defined as the right of others to take advantage of the land, and the land which is assumed to bear the right to use the land is called the service.
