PAGE PAGE 16 交通肇事罪的若干问题研究 摘要：交通事故，是指车辆在道路上因过错或者意外造成人身伤亡或者财产损失的事件。交通肇事罪，是指违反道路交通管理法规，引起重大交通事故，致人重伤甚至死亡或者造成公私财产遭受损失，依法被追究刑事责任的犯罪行为。在现实生活中，交通肇事的案件层出不穷，对人们的生命和财产造成了极大的危险。醉酒驾车导致的交通肇事，因逃逸致人死亡的交通肇事，还有一些违反交通法规造成的交通肇事，都在提示着需要对交通肇事法规的完善。虽然我国先如今的交通法律法规已经是相对比较完善，但是还是有很多人在钻法律的漏洞，依靠自己的小聪明来逃脱法律的制裁，人民的生产生活受到了极大的威胁。这里主要从司法实践出发，结合各学者的观点以及自己的一些看法，介绍了交通肇事罪的主体，交通肇事罪中的共犯和自首，醉酒与交通肇事的关系以及交通肇事中的逃逸并且进行了简单的讨论，期望这些问题能引起社会的关注，给予司法一些帮助。 关键词：交通肇事主体；共犯；自首；醉酒驾车；逃逸 Several studies of the traffic accident Abstract: The traffic accidents refers to the vehicle on the road of life or personal injury caused by fault or accident or damage to property.Traffic accident crime is who break the road traffic management regulations,and someone majors the traffic accidents ,causes the loss of public or private property or injures the people life.In real life ,the traffic accident cases emerge in endlessly.It is very dangerous to our lives.Drink driving,someone who dues to escape the deadly traffic accident and there are more and more break the road traffic management regulations.It is tells us that we should modify the road traffic management regulations.Of course,in china,the road traffic management regulations is just okay.but there are still a lot of people in a loophole in the law, to rely on their own wits to escape from the law, the peoples production and living under great threat.This article mainly embarks from the judicial practice, combined with some views of various scholars and my own views,Introduces the main problems in the traffic accident dispute over the accomplice, the second is the cognizance of surrender, drunk driving, the escape of traffic accident caused by the deadly problem.Then I discuss them ,and expect these problems can cause the attention of the society, to give some legal help. Keywords: Legislative Transparency;Legislative ;make public 关于交通肇事罪，我国刑法、刑事诉讼法中早已有明文规定，虽然其理论和实践地位已经得到学界普遍的承认，但是对于交通肇事罪，它的多种形式以及认定，不同的学者有着不同的观点。比如说交通肇事后的逃逸，行为人的主观状态到底是故意的还是过失的，亦或是过失兼故意，这些问题都值得探讨，一系列的问题都有颇多
