我国护士处方权立法中的问题检视与路径优化

基于对《深圳经济特区医疗条例》第65条的分析

摘要：《深圳经济特区医疗条例》率先在中国尝试对护士处方权立法。但其离真正落地还有诸多问题须解决，如护士处方

权的权限范围较为狭窄、配套实施机制尚付阙如、该权下的医护关系权责不明等，故护士处方权的立法完善，可以从合理确定

该权的权限范围、明确医生和护士之间的权利义务界限、完善护士处方权的配套实施机制等维度进行。

Abstract:MedicalRegulationsofShenzhenSpecialEconomicZonehastakentheleadinimplementingthenursesprescription

rightinChina,buttherearestillmanyproblemsinthefullimplementationofnursesprescriptionrightinChinasuchastherelatively

narrowscopeofthenursesprescriptionright,thesupportingimplementationmechanismisstilllacking,andthepowerandresponsibility

ofthemedicalrelationshipundertherightisunclear.Therefore,thelegislativeimprovementofnursesprescribingrightcanbecarried

outfromthedimensionsofreasonablydeterminingthescopeoftheright,clarifyingtheboundaryofrightsandobligationsbetweendoc-

torsandnurses,andimprovingthesupportingimplementationmechanismofnursesprescribingright.
