交通事故侵权责任认定的困境与出路

摘要：随着人工智能技术迅猛发展，无人驾驶技术得以商业化落地并展现巨大应用潜力的同时也引发了不少交

通事故。如何应对无人驾驶汽车交通事故中引发的大量法律问题亟须解决。当前，L4至L5级无人驾驶汽车交通

事故侵权责任认定存在侵权主体不明确、归责原则难适用、举证过程无救济、损害赔偿无规则等诸多问题，针对

这些问题可采取“由物到人”的递进式侵权主体判定标准、适用三元归责原则、建立以“鉴定、证据、责任、援

助”为中心的举证救济机制及构建“新型车辆责任保险制度+损害赔偿基金”双重损害赔偿规则体系等应对措施，

促进无人驾驶汽车交通事故侵权法律体系的完整性与可执行性，进而达到保障受害人合法权益和推动行业稳健发

展的双重目标。

Abstract:Inrecentyears,withtherapiddevelopmentofartificialintelligencetechnology,

autonomousdrivingtechnologyhasbeencommerciallyappliedandshowngreatpotentialfor

application,whilealsocausinganumberoftrafficaccidents.Howtoaddressthenumerouslegal

issuesarisingfromautonomousvehicletrafficaccidentsurgentlyneedstoberesolved.Therefore,

thisarticleaimstoproposefeasiblesolutionstosomeofthepracticaldilemmasintheidentification

oftortliabilityfortrafficaccidentsinvolvingL4toL5levelautonomousvehicles.Specifically:to

addresstheissueofunclearinfringementsubjects,aprogressivedeterminationstandardoffrom

objecttopersonisadopted;toaddresstheissueofinapplicableattributionprinciples,theternary
