论文摘要 行政调查是行政机关为实现一定的行政目的，依据法律规定的行政职权向行 政相对人所为的收集信息、获取证据的行政活动。随着社会经济的逐步发展，行 政机关需要进行的调查事项越来越多，行政调查作为政府了解情况、收集信息的 重要手段，在日常行政管理活动中得到广泛运用。行政机关行使调查权的活动与 公民权密切相关，但由于我国关于行政调查理论研究的滞后和立法的缺失，我国 行政调查的进行无法可依，在调查过程中侵犯相对人合法权益的情况层出不穷。 因此，必须明确行政调查的法律性质和法律地位，构建行政调查的程序制度，对 其实施依据、实施主体、实施方式和实施过程中应遵循的原则加以法律规制，对 其实施过程中给相对人造成的权益损害提供有效的救济，以此达到制约行政机关 行政权和保护相对人合法权益的目的，推进行政机关依法行政，构建社会主义和 谐社会。 关键词：行政调查 法律规制 程序规范 法律救济 Abstract Administrative investigation is a kind of administrative activities that administrative organs on the basis of its powers collect information and obtain evidence from administrative relative person, in order to achieve certain administrative purpose. Along with the gradual development of social and economic, there are more and more matters need to be invest -tailgated by administrative organs. As an important means of collecting information and understanding situation, administrative investigation has been widely used in the daily administrative management activities. The procedure of exercising the power of investigation has intimate affect on citizenship, but because of the lag of fundamental research on administrative investigation and the lack of legislation in China, there are no laws and regulations could be in accordance with by administrative investigation. Hence, the legitimate rights and interests of the situation counterpart are infringed endlessly in investigation process. In order to restrict administrative power of administrative organs and protect the legitimate rights and interests of the counterpart, first, we should be clear about the legal nature and legal status of administrative investigation; then, we should construct the procedure syst
