摘 要 融资融券交易是我国为了促进证券市场健康发展，完善金融市场而推出的重 要举措。随着我国融资融券业务试点的推行，融资融券交易对市场产生了深远的 影响，同时也带来了对融资融券交易风险监管的挑战。我国融资融券交易风险监 管在摸索中前进，虽然出台了一系列关于融资融券业务试点的法律法规，但是在 试点的过程中，还是出现了许多问题。通过试点阶段的运行，现行法律法规政策 的研究，发现我国的融资融券在证券市场转融通模式上、现有法律冲突上、具体 的规则规范上还存在不完善的地方。在完善融资融券交易风险监管的过程中必须 遵循保护投资者利益原则、公平公正公开原则、效率原则、依法监管原则。在坚 持以上原则的前提下，采取推进融资融券业务的国务院立法进程，制定相对较高 级别的法律法规，完善证券市场的转融通机制，健全担保制度等措施来完善我国 的融资融券交易风险监管。 关键词：融资融券交易；风险监管；转融通机制；担保制度 1 Abstract Margin Trading is an important measure, in order to promote the sound development of securities market in China and improve the financial markets. With the implementation of pilot programs for margin trade, margin trade has deep influence for the market, but it also has brought the challenge for the margin trade risk supervision. Our margin trade risk supervision is still on the progress, although there are a series of laws and regulations about margin trade pilot, the problems has arisen in the process. Through the operation of the pilot phase and the research of the existing law s and regulations, it has found that the margin trade is still not perfect on the mode of financing system and the existing conflict of laws, as well as the specific rules and regulations in our country. In the process of improving for the margin trade risk supervision, it must be followed the principles of protect investors benefits, and the principles of openness and fairness, the principle of efficiency, as well as public law supervision principles.
