I 农村纠纷解决机制的法经济学分析 摘 要 法经济学（Law and Economics）又称为法律的经济分析（Economic Analysis of Law），也有人称为经济分析法学，指适用经济学的理论和方法 到整个法律体系，具体地说，就是以经济学的理论和方法研究法律问题，或以 法律为分析的对象，而以经济分析为分析的方法。经济分析方法的切入意味着 一场新的革命，一种研究方法的革命，是一种崭新的视角。因此，本文立足于 法经济学研究的范畴，根据法经济学理论，对农村纠纷解决机制进行剖析。根 据纠纷当事人在纠纷发生后采取的种种对策，基于经济学上“理性人”的假设 等经济学理论，对各种纠纷解决模式的产生、在实际中的效用以及纠纷解决机 制的构建等问题进行了探究。文章共五个部分，第一部分描述了我国农村纠纷 解决机制的现状，突出本文的研究问题，并归纳出正义与效率在选择农村纠纷 解决机制上的意义；第二部分是对农村纠纷解决机制进行法经济学分析的基本 假设；第三部分为官方解纷方式的法经济学分析；第四部分是民间解纷方式的 法经济学分析，这部分主要是通过对官方和民间两者解纷方式的经济成本比较， 来突出在农村民间解纷方式的优劣势所在；第五部分针对第三、四部分农村解 纷制度的相关问题，在法经济学视角下提出完善建议。 关键词：农村纠纷；解决机制；效率；法经济学 万方数据 II Law economic analysis on the solving mechanism of disputes in Rural Communities ABSTRACT The theory of Law and Economies is also called Economic Analysis of Law. It is a kind of new theory with which law is studied，in other words，law is studied by the way of economic analysis. The theory of Law and Economics means a revolution，a revolution of research method，a new view of study of law. Therefore, this article tries to analyze the solving mechanism of civil dispute based on the legal theory. Various counter plans that the party concerned of the civil dispute adopts after dispute takes places and the assumption of the economic theory of “rational person”, researches the issues of the creation of the various dispute solving mode, the actual effect and the establishment of dispute solving mechanism. The article is divided into five parts. In the first part, the author described the status of the solving mechanism of disputes in Rural Communities, highlighting the questions of the research, and summarized the justice and efficiency in the choice of the significance of the solving mechanism of disputes in Rural Communities. In the second part is the basic assumptions of Law and Economics to the solving mechanism of disputes in Rural Communities. The third part is the law and economic analysis on the formal resolvent. The fourth part is the law and eco
