第3卷 第1期 大连海事大学学报(社会科学版) Vo1．3，No．1 2004年3月 Journal of Dalian Maritime University(Social Sciences Edition) Mar．，2004 论我国刑法中的目的犯 邵维国 ，吴晓红 (1．大连海事大学 法学院，辽宁 大连 116026； 2．丹东市中级人民法院，辽宁 丹东 118000) 确要：目的犯之“目的”，实质是犯罪动机。为尊重现有刑法理论称谓，并与刑法分则条文规定相符，将这种 目的称为“第二种意义的犯罪目的”是可取的。目的犯之目的，不是犯罪故意的内容。它是故意之外独立的主 观要件。刑法分则将第二种意义的犯罪目的特别规定为犯罪构成要件的价值在于：其一，只有具有第二种意 义的犯罪目的，行为才能对客体造成侵害；其二，只有具有第二种意义的犯罪目的，行为的社会危害性才能达 到犯罪程度；其三，第二种意义的犯罪目的只是某些犯罪的特别主观要件，必须由刑法分则规定。刑法分则规 定目的犯之目的采取两种方式：一是包含式的方式；二是明文规定的方式。据此，可将目的犯分为两类。 关键 司：目的犯；第二种意义的犯罪目的；价值；分类 中图分类号：D924 文献标识码：A 文章编号：1671．7031(2004)01．0034．05 On the crime with special motive Shao Weiguo ，Wu Xiaohong2 (1．Law College，Dalian Maritime Univ．，Dalian 1 16026，China； 2．Dandong Intermediate People’s Court，Dandong 1 1 8000，China) Abstract：The purpose of the crime with special motive is a kind of criminal motive．To maintain the corn— mOB appellation in criminal law theory，accord with stipulation of criminal law，we can call this purpose the second—meaning criminal purpose．The special motive is not content of the criminal intention．It is a kind of independent requisite of constitution of crime．The significances that criminal law stipulate the crime with special motive lies：firstly，only if a harmful conduct has special motive，can it harm the object of crime； secondly，only if a harmful conduct has special motive，can it leads to crime；thirdly，only if criminal law stipulate the special motive，can it become requisite of constitution of crime．The ways that criminal law stipulate the special motive are as follow：first containing way，second the way of stipulating in explicit terms．On these grounds，we can classify the crimes with special motive into two kinds． K
