On the one hand , the administrative discretion is helpful to the administrative body to enhance administrative efficiency , and perform administrative functions; hence it is necessity for its existence; On the other hand , it is bound to result in the violations of the legitimate rights and interests of the executive relative without the reasonable control of the administrative discretion in its operation. , and the threats rule of law to the executive. which will affect the realization of fairness and justice. Therefore , it is very necessary to strengthen the administrative control of discretionary power to prevent its abuse. It shows that the judi- cial review is the effective way to control the abuse of the administrative discretion and realize the aim of the protection of legitimate rights and interests of the executive relative.
