AbstractForalongtime,ourcountrycriminaljusticepractice,therehasalwaysbeentheproblem ofarrestedcustodygeneralization,highrateofcustody.NewCriminal Procedureadded necessitycustodycensorship,practiceandacademiccircleshaveconductedextensive research, butmoreforthelawof legislation perfect suggestion orshort term report,formed by theviewofthelackofoperability.Inordertoenhancetheoperabilityofdetentionnecessity ofcensorship,basedonthecombinationoftheoryandpracticeresearch,selecttheCCity Procuratoratepracticeofdetentionnecessityofcensorshipin2013firsthalf,analyzedthe researchnecessitycustodyreviewpracticesituationinourcountryandthesystemrunning sincealsotheexistingproblems,andfurtherexploretheeffectivepath,inordertopromote theconstantimprovementofthemechanism,bettersafeguardtherightsofcriminalsuspects and defendants.This article is divided into fourparts, atotal of about million words.Thefirstpartisnecessityreviewsummaryforcustody.Thissectiondiscussesthe conceptofdetention,detentionnecessitytoreviewtheconceptandvalueaswellasthe necessitytocarryoutthedetentionreviewoutsideofpractice.Custodyhasbroadsenseand narrowsense,thispaperusesisnarrow,referstobeforethecourtofficial,inordertoensure thesmoothprogressofcriminalprocedure,tothecriminalsuspectordefendantadopt measurestorestrictionofpersonalfreedom.Detentionnecessityreviewreferstothe procuratorialorgantothecriminalsuspectordefendantbeforethearrestuntilthecourt decision,whethertocontinuethenecessityofcustodyreviewacustodysupervisionsystem. Detentionnecessityfortheestablishmentofthereviewprovidesthedetainedpersonakindof institutionalreliefway,isthevalueofthefouraspects:toperfect thecustodysystem, strengthentheprotectionofhumanrights,strengtheningthelegalsupervisionandreduce formforcustody.Countriesoutsidethenecessityincustodyreviewonformeda comparativelycompletesystemofamainlimitofdetentionmeasuresfromthreeaspects:a limitonthesubstantialrequirementsfromcustody,mainlyreflectedintheestablishmentof detentionnecessityprincipleandapp
