ABSTRACTEU PUBLIC PARTICIPATION IN THE ENVIRONMENTAL IMPACT ASSESSMENT: WHAT CHINA CAN LEARN FROM EU?ABSTRACTAfter suffering the environmental pollutions so many years, EU has made a whole special legal system to rebuild the environmental legal system which has been demonstrated as a huge success, especially the environmental impact assessment. According to the EIA directive, member states can decide the format, content, and even every link during the process of the whole EIA by themselves. EU gives member states wide discretion.The EIA directive requires member states to carry out environmental impact assessments on certain public and private projects before they are authorized. For some projects like construction of motorways, airfields and nuclear power stations, such assessments are obligatory. The reason why EU EIA system is so successful during the loose context is because every detail which member states regulate by themselves must abide by the legal aims of EU laws. This article shows us environmental impact assessment in EU has been a very useful tool for promoting environmental protection which makes member states step up implementation of the EIA directive by translating it into national law and reducing infringement cases. To ensure better implementation of the directive, the EU monitors its enforcement and provides guidance in consultation with member states, the EU hopefuls and stakeholders like non-governmental organizations.This article examines the whole process on the public participation in the EU environmental impact assessment by focusing on the process of environmental impact assessment in EU through some important directives and cases, especially the EIA Directive.
