with,andalsoabigchallengethatwasleftbyIndustrialRevolution.Climatechangeisnotonlyanenvironmentalissue,butalsoacomplexissuewhichinvolvespolitics,economy,society,diplomacyandsecurity.Therefore,studyingtherelativelegalsystemofclimatechangeisoneoftheimportantpartsofmethodsadoptedbycountriestodealwithclimatechange.TheUNFCCCconferenceofthepartiesatitsfifteenthsession(COP15)washeldinCopenhagen,DenmarkfromDecember7thtoDecember18th,2009.Therewasnolegallybindingagreementachievedinthisconference,butapoliticalarrangementwasagreedon—theCopenhagenAccord,whichlefttheactualissuesforfuturenegotiations.Itseemsnotveryoptimistictoreachaninternationallegalagreementonclimatechangeforthepost-Kyotoperiodinthenearfuture.Ican’thelptothinkaboutthatifinternationallawwillsolvethecomplexproblemofclimatechangeandhow?Accordingtointernationallaw,whetherornotacountrycanbeheldstateresponsibilityforthecurrentandfuturelosscausedbyclimatechange?Arethereanyobligationsforcountriestopreventthedamage,andcompensateforthelossofhappeneddamages?Therefore,theinternationallegalregimeswithregardtoclimatechangeshallbeanalyzedfrommacroandmicropointofviewinthispaper,whichalsostudytheaccessanddifficultiesonstateresponsibilitytosolvethisproblem.Thispaperiscomposedofthreemainparts:Firstly,thispaperdescribesthecurrentsituation,effect,andcauseofclimatechange.Analyzingthescientificandtechnologicalfigureandinformationaboutclimatechangefromhomeandabroad,providescientificbasisfortheimportanceandurgencytocopewithclimatechange,especiallybytheinternationallaw.Secondly,internationaltreatylaw,negotiation,andinternationalcustomarylawrelatedtoclimatechangeshallbeanalyzedinamacropointofview,especiallyfortheUnitedNationsFrameworkConventiononClimateChange,KyotoProtocol,theBaliRoadmap,andtheCopenhagenAccordshallalsobereferredto.Furthermore,thecomparisonbetweeninternationaltreatylawandcustomarylaw,anddiscussionoftheNoHarmRuleintheinternationallawcaseswillhelptodefinethedamagecausedbyclimatechange.Theaboveanalysisanddiscussiongivesalegalb
