AbstractThe judgement standard of automotive design defects has a significant impact on how to identify the automotive design defects .In our country, the judgement standard system of automotive design defects is imperfect .So in some judicial practice, the car exists design defects but the court can not identify defects in accordance with existing standards. On the contrary, product liability law in the United States has a long history ,and the judgement standard system of automotive design defects is perfect. It plays an important role to protect the legitimate rights and interests of consumers. This article analysis the judgement standard of automotive design defects deeply from comparing the difference of automotive design defects between China and the United States. This article presents a proposal with a lot of cases in order to protect the legitimate rights and interests of consumers.The article is divided into five parts: In the first part, the author proposes an overview of the automotive design defects with a case; The second part is to introduce the technical standard and the standard of unreasonable risk in our country; In the third part, the main idea is to analysis the judgement standard system of automotive design defects in the United States; In the fourth part, the author introduce several factors which have infects on the judgement standard of automotive design defects ;In the last part, this article analysis the judgement standard of automotive design defects deeply from comparing the difference of automotive design defects between China and the United States and presents a proposal in order to perfect the judgement standard of automotive design defects in our country.Keywords: automotive; design defects; judgement standard目录摘要 ...............................................................................
