浅谈保险法中如实告知义务 摘　要 随着人民生活水平的不断提高，我国保险业逐步发展，公民对保险的保障和投资作用认识的深入，办理保险的人群逐渐壮大，但在日常保险合同的订立和保险责任的划分以及保险的赔付方面却存在这样或那样的矛盾，这就对保险业的发展产生了一定的障碍。因此，本文就保险合同订立过程中的如实告知义务——即在保险合同订立过程中，当事人依法将与合同订立有关的事实如实向对方陈述或说明的义务进行阐述。内容包含：一、告知义务的立法目的---任何保险合同的订立，都必须以告知义务的履行为前提；二、告知义务的内容；三、告知义务的主体----保险合同的当事人，即投保人和保险人；四、告知义务的履行----投被保人告知义务的履行和保险人告知义务的履行；五、告知义务的违反及后果，主要对投保人违反告知义务的构成要件及后果和保险人违反告知义务的后果进行分析。 关 键 词：保险合同 如实告知 义务履行 论文类型：理论研究 On the informing obligation in Insurance Law ABSTRACT With the continuous improvement of peoples living standards, Chinas insurance industry gradually developed, citizens of the insurance and investment action understanding, insured population expands gradually, but in the daily insurance contract and insurance liability division and insurance payment is put in such and such a contradiction, the insurance industry development has certain obstacle.
