1 1 内容摘要 随着时代的发展，伴随着对于贿赂犯罪的进一步打击，行、受贿的技巧也在不断提 高，行贿正从贿赂金钱、房子、汽车等直接的财物贿赂方式转向其他比较隐蔽的贿赂方 式。司法实践表明，以权色交易的贿赂方式在实践中呈现出逐渐上升的趋势，而以“性 贿赂”形式所表现的权色交易的贿赂行为具有相当的隐蔽性，故其对公务人员廉洁性和 社会的公权的侵犯程度就呈现出更为严重之态势。1997 年《中华人民共和国刑法》及其 七个修正案均没有将之列为犯罪的范畴。 “性贿赂”在刑法领域中一直都是一个颇具争议的问题，早在 20 世纪 80 年代中期， 我国一些刑法学者曾就此问题展开过激烈的争论。2000 年 12 月 6 日，在江苏常州召开 的“2000 年江苏省刑法学研讨会”上，南京大学硕士研究生金卫东所提交的《应设立“性 贿赂罪”》一文再次掀起该问题争论的热潮。鉴于此，本文对“性贿赂”的内涵进行深入 的剖析，以及其犯罪化的正当性进行具体论证，并对“性贿赂”犯罪化的定罪、量刑提出 初步构想。笔者主张适时的扩大贿赂的范围，将“性贿赂”纳入贿赂罪中进行规制；而对 于某些学者的否定态度，笔者认为，我们应走出对贿赂物传统的狭隘理解的思维定势中， 还原贿赂物内涵之真相；借鉴国外有关刑事立法的经验，将“性贿赂”行为犯罪化，形成 有效的预防和打击体系，真正实现刑法惩治犯罪的目的。 关键词：性贿赂；犯罪化；争议；司法考量 1 1 Abstract With the development of further crackdown on the crime of bribery, the skills of bribery has also developed from the way of direct bribery, such as money, house, cars etc to the way of more hidden behaviors. Criminal justice practice has shown that sexual bribery has a gradually rising trend, and the special characteristic concealment of sexual bribery will naturally has a more serious infringement to both the probity of public servant and public rights. However, the Criminal Law of the PRC 1997 and it’s seven amendments have not criminalized the behavior of sexual bribery. “Sexual Bribery” has always been a very disputed issue which it’s sever debate can be traced back to the mid-80’s of last century in China. Mr. Jin Weidong, who submitted his LLM’s dissertation “China should set up the Crime of Sexual Bribery” on Jiangsu Province Criminology Forum 2000, had raised the issue to the upsurge again. This essay has deeply dug into the content and the justification of criminalization of sexual bribery as well as its conviction and penalty measurement. The author proposes that sexual bribery should be criminalized in the scale of Bribery. As to some scholars’ denial opinions towards the sexual bribery, the author advocates that we should jump out of the traditional rigid understanding of the materiality of bribery and concentrate on the truths of connotation of bribe
