I I 摘 要 摘 要 辩护权是被追诉人的核心诉讼权利。刑事诉讼的文明史就是辩护权的发展史。由于 律师辩护对于被追诉人权利保障的重要性，我国于 2012年3月 14 日经全国人大会议审 议通过了刑事诉讼法修正案，修改后的《中华人民共和国刑事诉讼法》已于 2013 年的 1 月 1 日起正式实施，新法将律师的辩护权从审判阶段扩展到侦查阶段，相应的侦查阶段 的辩护权也有所发展。本文在分析自侦案件本身特点、自侦案件侦查模式的特点的基础 上，从修正后的《中华人民共和国刑事诉讼法》实施前后的自侦案件侦查工作中关于辩 护权的相关问题入手，着重研究自侦案件侦查中的辩护权保障问题。文章分为三个部分， 第一部分介绍我国自侦案件的范围与特点，分析自侦案件侦查中辩护权保障的意义及现 状；第二部分通过修正后的《中华人民共和国刑事诉讼法》实施前后自侦案件侦查中辩 护权的比较，阐述刑诉法修正对自侦案件侦查中辩护权保障的意义，并对本次立法修正 的不彻底性进行探讨，第三部分结合自侦案件侦查工作实际，探讨确保自侦案件侦查中 辩护权充分行使的对策，对刑事诉讼工作现代化进程进行展望。身为自侦工作者，笔者 通过对自侦案件侦查中的辩护权保障问题研究，试图从观念上树立权利本位的理念，强 调在自侦侦查工作对辩护权的保障，提出对辩护权相关司法救济制度建设的希冀，推进 我国刑事自侦工作朝着更加民主、文明的方向发展。 关键词 自侦案件 侦查 辩护权 司法救济 II II Abstract Abstract The accused the right to defense is a core right of action.
