I I PAGE PAGE VI 摘 要 城中村改造是目前我国实现城镇化发展的必经途径，其本质是对社会、公共资源的 一种优化与再分配，同时又是一项与广大群众特别是农民生活息息相关的民生工程。特 别是在城中村改造过程中涉及到的土地征收、拆迁补偿以及村民安置等内容均牵涉到广 大群众的切身利益，在当前我国社会民主法治建设取得巨大进步的历史条件下，充分尊 重公众意见、倾听公众心声以及维护公众尤其是弱势群体的根本利益才能获得公众的理 解与支持。因此，在城中村改造中引入公民参与，已成为政府土地征收工作中的一项重 要且必要的事情。 本文主要采用文献研究法和个案分析法来构建起本文的分析框架，并就此分析实际 情况。本文首先对研究背景、选题意义、国内外研究现状以及研究思路和方法进行介绍， 然后对公民参与和城中村改造的相关概念及理论进行介绍并对公民参与在城中村改造 的作用进行分析。在此基础上，以开封市开封新区数个城中村改造中的公民参与为例， 通过公民参与实践、结论调查和分析评价，总结分析出了城中村改造中公民参与诟病的 症结所在，主要包括四个方面：公民参与文化素养匮乏；政府的权能扩大化；政府与公 民之间信任关系的缺失以及公民参与法制保障不健全。最后，文章根据我国目前城中村 改造中公民参与的现状，初步构架了完善城中村改造中公民参与的优化路径，主要有以 下五个方面：培育有序的城中村改造公民参与文化，历练公民精神；构建多元化的城中 村改造公民参与网络；合理有效规制政府权能；重塑政府和公众之间的互信，形成双方 的良性互动以及健全参与的法律保障机制，实现参与效力最大化。 关键词：城中村改造，公民参与，分析，路径 III III PAGE PAGE IV ABSTRACT Nowadays in China reconstruction of the city village is a necessary way to realize the development of urbanization. Its essence is to optimize and redistribute the social and public resources. And at the same time it is a people project which is closely related to the life of masses, especially the peasants. In the process of reconstruction of the village in city exists many things involves with the vital interests of the masses, such as the land acquisition, demolition compensation and resettlement of the villagers. In the conditions that the construction of society democracy and rule has made great progress, it will obtain the understanding and support of the public if we can full respect the opinion of the public, listen voice of the public, maintenance the interests of the public especially the vulnerable groups. Therefore in the process of reconstruction of the city village implement citizen participation has become an important and necessary thing in the work of the government to collect the land. The article adopts the literature research method and case analysis method to construct the framework and to analyze the actual situation. Firstly the article introduce the research background, the significance of the topic, the research status
