1 1 内 容 摘 要 2011 年 11 月 20 日，最高人民法院印发《关于发布第一批指导性案例的通知》，决 定将上海中原物业顾问有限公司诉陶德华居间合同纠纷案等 4 个案例作为第一批指导性 案例予以公布，标志着我国案例指导制度已经进入司法实践操作运行阶段。然而，要构 建适应中国既有体制的判例制度，离不开对域外经验的借鉴。而典型意义上的判例制度， 源于英美法系。遵循先例原则是判例法的一个基本原则，它是判例法得以形成的基础。 本文运用比较法学的思维，从遵循先例原则出发，从判例法运作的逻辑出发，重点考察 并厘清遵循先例形成的历史原因、社会现实的适应及运作的逻辑，继而对我国案例指导 制度进行客观的评析并给予合理化建议。 本文包括引言、正文（分为五个部分）和结语。 引言部分，对本文的写作目的、思路和研究方法进行说明。 第一部分，考察并厘清遵循先例形成的历史原因、社会现实的适应及运作的逻辑。 第二部分，对中国案例指导制度进行历史分析性考察，并对案例指导制度的作用及 局限性进行了检讨。 第三部分，以两个官方公布的案例为蓝本，对英美判例法遵循先例与中国案例指导 制度进行比较分析，这是本文的重要组成部分。该部分通过案例来寻找判例法与案例指 导制度的比较点，并得出相应结论与启示。 第四部分，在前文比较分析的基础上，指出由案例指导制度走向有中国特色的判例 法是理性司法改革方向，并对此进行相应论证。 第五部分，对案例指导制度的后续建设即引入判例制度给予合理化建议。 结语部分，在肯定由最高人民法院主导的案例指导制度具有革命性意义的同时，指 出该制度也面临诸多挑战，除官方强力推进外，还需要国人大众的认同和自律。 关键词：判例法；遵循先例；案例指导制度；指导性案例 1 1 2 2 Abstract November 20, 2011, the supreme peoples court issued the first batch of guidance issued by the case of notice of, decided to Shanghai centaline property consultants Co., ltd., v.
