“终身禁止”类行政处罚研究 中文摘要 “终身禁止”类行政处罚研究 中文摘要 面对纷繁复杂的执法环境，执法者创制着各种新型的政府规制手段，终身禁止便 作为其中之一进入了我们的视野。在以《道路交通法》《娱乐场所管理条例》《教师法》 等为代表，涉及公共安全、行业秩序、资格管理等的不同领域，均有“终身禁止”类 规定的身影。从日益增多的终身禁驾、终身禁足、终身禁考处罚中，行政机关对于该 类行政手段的认可度可见一斑。固然，终身禁止在关乎国民生命安全、行业秩序之维 护等高危领域，将重大违法行为者彻底拒之门外、斩断再行违法之可能性，起着无可 比拟的作用。然而，法律依据的缺位、形式要件的粗糙及程序规定的欠缺，均暴露了 该治理手段在立法和实践层面的混乱。笔者将存在该类规定的现行法律规范，以所欲 保护的法益为依据进行梳理。进而尽可能对当下不同形式的终身禁止处罚予以分门别 类，与此同时对当下学界与司法界传统的行政处罚种类提出了质疑，并提出了自己的 分类。文中，笔者从宪法职业自由的角度出发，阐释了终身禁止手段的不当运用将会 对公民的基本宪法权利造成何等严重的损害。最终，回归到法律控制面向，呼吁从实 体、程序两方面对该手段予以有效、审慎的规制。 关键字：终身禁止； 行政处罚； 类型化 作 者：李 洋 指导老师：章志远 Abstract Legal Analysis of Lifetime forbidden Of Administrative penalty Legal Analysis of Lifetime forbidden Of Administrative penalty Abstract In the face of the complicated law enforcement situation,regulators are also creating new means of government regulation,lifetime forbidden of administrative penalty is one of them,it has been employed in many regions,such as public security,qualification test,etc. To some extent, it plays an incomparable role for forbidding serious violators into some important regions. Otherwise,lack of legal basis and procedure rules exposed the chaos of legislation and practice level.I have settled the provisions of current legal regulations on the basis of legal interests to be protected,so as to classify and categorize all of them.Meanwhile,i have questioned the traditional types of categorizing of administrative penalties,then put forward my own opinion.As one part of the thesis,i have set the professional angle of constitutional freedom,illustrates the severe damage to citizens basic constitutional rights when improper use of this administrative penalty.At last,this thesis go back to the aspect of legal control, appeal for regulate this new means of administrative penalty prudently and effectively.
