However, compared with the great progress in environmental law practice, the research on environmental law has been characterized by “theoretical non-performance” and “weak interpretation”. The Party, the state and the society are the core elements affecting the environmental rule of law in China. From the Marxist point of view, the “Partystate-society” relationship determines the basic framework and shapes the theoretical core of China’ s environmental rule of law. Within this theoretical framework, the environmental rule of law in contemporary China, which takes the “protection and improvement of people’ s livelihood” as its value pursuit and the fulfillment and realization of the State obligations of environmental protection as its core content, can realize institutional innovation through authorization and entrustment and more reasonable explanations can be given to the phenomenon of environmental laws functioning increasingly like policies and the problems arising from the reform of the system of environmental public interest litigation.
