农民工养老保险的关系转移接续问题探析 　　摘要：目前我国社会保险统筹层次较低，养老保险关系转移接续不顺畅，极大地制约着农民工的流动和劳动力资源的合理配置。导致农民工养老保险关系转移接续难，有农民工本身流动性强方面的原因，也有企业设法逃避农民工养老保险责任的因素，但政策的制定存在缺陷是其最重要的原因。应加强有关立法工作，并完善监督机制；提高统筹层次，实现养老保险的全国统筹；制定关系转移接续办法，建立完善的个人账户制和全国统一的社保信息服务系统。 　　关键词：农民工；养老保险关系；全国统筹；个人账户制；社保信息服务系统 　　中图分类号：F840.67 文献标识码：A文章编号：1008-6439（2009）01-0017-06 　　 　　Analysis of social endowment insurance relations transfer and continuity for peasant―workers 　　WEN Hai-hong, DUAN Ya-hui 　　(School of Public Policy and Administration, Xian Jiaotong University, Shaanxi Xian 710049, China) 　　Abstract：At present, the overall plan level of China’s social insurance is somewhat low, the transfer and continuity of Social Endowment Insurance relationship is not smooth, which greatly restrict the flow of peasant―workers and the rational allocation of labor resources. The difficult transfer and continuity of peasant―workers come from frequent flow of peasant-workers and entrepreneurs’ escaping liability but the most important reason is the policies’ defects. The related legislation should be enhanced to perfect supervision mechanism and to raise overall level so as to realize nationwide overall endowment insurance by making transfer-connection methods and by establishing personal account and overall nationwide unified social security service information system. 　　Keywords：peasant―workers; Social Endowment Insurance relations; overall nationwide; personal account; social security information service system 　　 　　一、引言 　　 　　 “农民工”是我国经济社会转型时期的特殊概念，是指农民脱离农业劳动在城镇从事非农产业的劳动者，以工资收入为主要生活来源，但没有放弃农村土地承包经营权。其特征是具有农村户口，户籍身份是农民，职业是从事第二、三产业的工人，是介于城乡之间的非农非城的边缘群体。他们的大规模流动，极大地冲击了我国以城乡户籍管理制度为基础的二元社会保险模式。田成平部长在十一届全国人大一次会议答记者问中指出当前农民工在全国已经超过了两亿，其中离开本乡本土到城市做工的大约有1.2亿左右。 　　 目前我国的养老保险统筹层次比较低，没有实现全国统筹或全面的省级统筹，妨碍社会保障发挥全社会互助共济的功能。由于各种原因，制度内的人员流动、养老保险关系的转移接续尚存在诸多问题，“过渡性群体”的农民工，他们的养老保险关系转移接续更是令人担忧。以深圳为例，2007年该市共有493.97万人参加基本养老保险,退保人数为83万人，而成功转保人数只有9 672人，也就是说，深圳10 000个参保人中就有1 680个人退保，而每10 000个参保人中成功转保的只有19人，比例仅为退保人数的1%[1]。这严重阻碍了农民工的流动和劳动力资源的合理
