I I 摘 要 随着经济的飞速发展 ，科学技术 日新月异 ，在我国的各个行政管理领域科学 技术被广泛的运用 。在科技与法治之间 ，因某些制度的不完善 ，使得科学技术在 实际的执法运用中受到了一定的阻力。近年来，随着交通行政管理部门 “电子 眼 ”、雷达测速等高科技设备的逐渐运用、普及，交通行政管理领域的非现场执 法现象的出现，在给交通管理部门带来便利的同时也带来了新的挑战。 交通管理非现场执法在国外的运用十分广泛 ，而且对行政管理作用巨大 。近 年来，我国公安交通管理部门将非现场执 法运用到交通管理行政执法实践当中， 适应了新时期公安交通管理工作的需要。 本文以我国交通行政管理执法为视角， 从交通管理非现场执法的概念切入 ，厘清了交通管理非现场执法与交通管理现场 执法 、交通管理非现场执法与暗中执法的 边界 ，讲明了交通管理非现场执法的必 要性和优越性 ，进而梳理了交通管理非现 场执法应遵循的基本原则 ，为如何正确 引导交通管理非现场执法作了铺垫 。然后 ，指出我国交通管理非现场执法存在的 缺陷和不足，最后就如何改进和完善交通 管理非现场执法模式提出了对策和建 议。 关键词：交通行政管理 非现场执法 暗中执法 完善 II II ABSTRACT With the rapid development of our economy, science technology changes with each passing day, and is put into practice in various fields of administrative management. The application of science technology into practice meets barriers because some systems are not perfect between science technology and law. With the popularization of the technical watching measures, such as “electron eye” and radar measuring, in traffic management department, there appears a phenomenon in the traffic administrative management—Law Enforcement Away From the Spot—which brings convenience as well as new changes to the traffic management department. Law Enforcement Away From the Spot has applied abroad overseas, and proves to be great helpful in administrative management. In the early of the 21st century, our traffic administrative management department applies Law Enforcement Away From the Spot to the practice of executing the law by administration, which meets the need of the department in a new era. The paper starts from the concept of Law Enforcement Away From the Spot, and clarifies the boundary between Law Enforcement Away From the Spot and “executing the law secretly”. It illustrates the main values of Law Enforcement Away From the Spot, and rearranges some basic principles which should be followed in executing the law, paving the road for directing the law enforcement in the right way.
