摘要 摘要 yS72256 根据教育产业和教育市场理论，学校和学生之间的关系是平 等的自由交换关系。二十世纪九十年代末，我国正式将教育界定 为第三产业，教育作为～种服务的观念得以确立。在现代市场经 济条件下，合同是实现教育服务与教育消费的市场交换关系的最 理想方式。在非义务教育实践中，已出现大量的教育合同。但是， 这些教育合同并不规范，不能发挥其应有的功能，现实生活呼唤 教育合同制度的确立。教育合同是指平等主体的教育机构与受教 育者或委培单位之间订立的，约定教育机构向受教育者提供特定 的非义务教育服务，受教育者或者委培单位向教育机构支付一定 教育成本的民事协议。教育合同将混杂在教育行政管理关系中的 民事部分剥离出来，单独加以明确，从而客观地反映非义务教育 领域的教育机构与受教育者之间的关系。教育合同具有民事合同 的一般特征，但在主体、客体、内容、成立与生效、履行、违约 责任及政府干预、与国家计划的关系等许多方面具有不同于其他 民事合同的特点，因此，关于教育合同的立法也应当确立科学的 思路，遵循特殊的原则，采用独特的模式。 关键词：教育合同 基础理论 基本制度 政府管制 立法思考 n AbstractThe Abstract The relationship between a school and its students is an equal and free exchange one according to the theory of education industry，as well as that of the education market．At the end of 1990’S，education was official ly designated to the brovince of the third industry，which forms the idea that education iS a kind of service．Under the condition of modern market economy，contracts iS the ideal way to realize the market exchange relationship between education service and educationconsu皿ption， increasing npmber of education contracts appear in the practice of uncompulsory education serv ice．But most of these contracts are not conform and consequently，they are not playing full use．Hence the establishment of education system is urgently required． Education contract is one that requires the education bodies offer intended uncompulsary education for the educationees on the foundation that educationees pay for the spedific education to the education bodies．Thus，education contracts will be seperated from the civil contracts of education administrative management and as a result，they will reflect the relationshiD between education bodies and educationees．Education contracta have the common characteristics of all the civil contracts．with its distinctive traits in objects， subjects， content， establishment and validity，enforcement，obligation， interference。of the gov
