西南科技大学硕士研究生学位论文 西南科技大学硕士研究生学位论文 第1页 摘 要 提高自主创新能力，建设创新型国家，这是国家发展战略的核心，是提高综 合国力的关键。企业作为自主创新的主体，其自主创新能力的强弱不仅直接关系 企业的市场竞争力，还影响到创新型国家战略目标的实现。创新型国家的成功经 验表明，法律是激励企业提升自主创新能力最重要的手段，研究激励企业自主创 新的法律制度具有重要意义。 本文首先对企业自主创新基本理论进行研究，结合我国企业自主创新现状， 指出我国企业自主创新能力依然薄弱，需要通过法律制度的完善激励企业提升自 主创新能力；而后从科技法、税法、专利法、人才法四个方面对创新型国家激励 企业自主创新的典型法律制度进行分析，提出其有益立法启示；再者通过对比我 国这四个方面的现行立法，指出我国激励企业自主创新的法律制度存在立法有空 白、体系欠科学、条文难贯彻等问题；最后针对这些不足，提出对激励企业自主 创新的科技法律制度、税收法律制度、专利法律制度、人才法律制度进行不断完 善，为企业自主创新提供良好的法律环境，达到激励企业提升自主创新能力、建 设创新型国家的目标。 关键词：企业 自主创新能力法律激励 西南科技大学硕士研究生学位论文 西南科技大学硕士研究生学位论文 第1I页 Abstract The core of national development strategy iS to enhance the capability of independent innovation and build up an innovation—oriented country．This is also the key to enhancing the comprehensive national strength．Enterprises are the main body of independent innovation，SO their independent innovation ability is not only directly related to the market competitiveness of enterprises，but also affects the realization of the strategy goal for the innovation—oriented country．Successful innovative experience in western countries shows that the law is the most important means of encouraging enterprises to enhance the ability of independent innovation．Therefore，it is important for US to study the incentive legal system of the independent innovation． 111is paper first introduces the basic theory on the independent innovation of enterprises．Combined with the innovation present situation in our country,it points out that the independent innovation ability of enterprises in our country is still weak and the incentive legal system of the independent innovation need to be perfected constantly．Then，through four aspects：the science and technology law,the tax law,the patent law,the personnel law,it makes analysis of the typical incentive legal systems in innovation—oriented countries，and puts forward the beneficial enlightenment to China’S legislation．Through current le西slation research on four aspects in our country,it points out that
