研究探讨。首先，对遗嘱的概念、法律特征及其历史沿革加以梳理， 研究探讨。首先，对遗嘱的概念、法律特征及其历史沿革加以梳理， 为冲突法的研究奠定坚实的民法基础；在此基础上对各国的遗嘱继承 法律制度加以比较，得出这一领域法律冲突存在的客观事实，从而引 出涉外遗嘱继承的法律适用的立法。接着，就涉外遗嘱继承的法律冲 突的解决，按照遗嘱继承的法律要件分别对各国相关的立法情况进行 了详细的论述；并根据各国目前的立法现状，对涉外遗嘱继承的法律 适用制度未来发展趋势提出自己的观点。最后，结合相关的理论知识， 对我国当前的最新立法条文加以评析，试着得出自己的解释说明，并 尝试将其适用于典型的案例之中，以为未来司法实践活动提供一些有 益的参考。同时，笔者也对我国区际冲突中遗嘱继承的法律适用制度 也提出了思考。 关键词：涉外遗嘱继承法律适用法律冲突 Ⅱ ABSTRACTThe ABSTRACT The testamentary succession is the system of succession which determines the inheritors and disposes of the estate in accordance with the wi ll made by the testate．Originating from the Roman Law,the succession system was stipulated in the succession Iaws of Modern countries．What’S more，the testamentary succession i s superior to legal inheri tance when dealing with the disposition of the estate in modern world． Moreover，the development of the testamentary succession is the main cri teria for judging the development of Civi l 1aw． The succession relationship is one of the relationships of property and is closed to the personal relationship，which is influenced greatly by the social system，economical system， historical tradition，religions belief and national customs． Because of the feature of the succession relationship，the 1aws of testamentary succession are varies from different countries and a lot of confl i ct of laws occurs．The testamentary succession in Private International Law is the system of testamentary succession engaged in foreign affairs．Solving the conflict of 1aws and setting up the application of 1aw are the main concerns of Private International Laws． The author Ⅱl notices notices that the Application Law of civil relationship was adopted by the 17th conference of standing committee of the llth NPC，which will take effect from April 1st，2011．There are some rules about the testamentary succession in this new 1aw which is the first time to stipulate the issues of foreign testamentary succession．Under this situation，the study of testamentary succession goes further
