摘要 摘要 I I 摘 要 长期以来在我国，生效裁判不能得到有效、完整执行的现象非常普遍，该 现象严重影响了法律权威，损害当事人的合法权益。2012 年 8 月新修改的《中 华人民共和国民事诉讼法》明确了我国检察机关对民事执行活动进行监督的合 法性，为检察机关参与破解“执行难”、“执行乱”困局提供了可能。但由于 规定过于原则，导致各地检察机关实践中无所适从，更难确切发挥民事执行检 察监督的作用。 本文从民事执行检察监督的概念、分类、特征、功能入手，分析民事执行 检察监督的定位和基本原则，在对我国民事执行检察监督问题成因分析的基础 上，借鉴法国、俄罗斯等国的民事执行检察监督制度的立法经验，指出当前我 国民事执行检察监督制度的完善，必须突破有限监督原则，功能重点定位于支 持执行工作，方能有效发挥民事执行检察监督制度的作用。在从执行工作流程、 执行权特点和民事执行检察监督作为强有力的外部监督手段等方面论证民事执 行检察监督对于改善执行工作的重要性后，笔者重新定位了民事检察权与民事 执行权的关系，并提出了从四个方面完善民事执行检察监督制度。一是设置民 事执行检察监督的启动方式，二是扩大民事执行检察监督的范围，三是增加民 事执行检察监督的方式，四是确定民事执行检察监督的管辖。笔者希望能藉由 民事执行检察监督制度的完善，破解“执行难”、“执行乱”问题，恢复司法 权威。 关键词： 民事执 行 检察监督 制度 完善 摘要II 摘要 II Abst Abstract III III Abstract A long time in our country, the effective judgment can not be effectively, full impleme ntation of the phenomenon is widespread, this phenomenon has seriously affected the autho rity of law, damage the legitimate rights and interests of the parties. In 2012 August the ne w revision of the PRC Civil Procedure Law has been clear about the legitimacy of the pr ocuratorial organ of our country to carry out supervision on execution of civil activities, as prosecutors involved in the crack of difficult to execute, implementation of chaos predic ament provides a possible. But because of the provisions are tooprinciple, leading to not kn ow what course to take procuratorial organspractice, more difficult to exactly play the role of the procuratorial supervision of civil execution. This article from the civil execution procuratorial supervision concept,classification, chara cteristic, function of the procuratorial supervision of civil execution, the analysis of the posi tion and basic principle, on the basis ofanalysis of the cause of our civil execution procurat orial supervision on, from France, Russia and other countries of the supervision system of civil implementation experience in legislation, and points out that the improvement in exec ution procuratorial supervision system the
