我国犯罪构成体系的内部混乱。同时，从我国刑法理论在借鉴构成要件要 素这一概念时具有的特殊性可以得出：犯罪对象、犯罪结果和因果关系都 是选择的构成要件要素，而刑事责任能力不是构成要件要素。由于犯罪构 成具有同一性和一致性，因此犯罪形态之间的差别不在于犯罪构成的不 同，而在于组成犯罪构成的构成要件要素的不同，这也解决了犯罪构成与 犯罪形态之间的矛盾。 关键词：构成要件；构成要件要素；客观的构成要件要素；主观的构 成要件要素 3 PAGE PAGE 1 Abstract In the criminal composing theories of China, the no usage of the concept “elements of constitutive requirements” results in the confusions and contradictions of the crime composing system. The most basic and simple way to solve these confusions and contradictions is to refer to and introduce the concept “elements of constitutive requirements” in Continental Law Legal system to China. Through this way, the criminal composing system of Chinese Criminal Law will be rebuilt. This paper is divided into four parts, altogether nearly 30,000 words. Chapter 1 introduces the concept, history and classification of the elements of constitutive requirements. The elements of constitutive requirements mean the elements which constitute the contents of composing system. With the deeply research about the criminal composing system, more and more penologists consider that the elements of constitutive requirements include not only external and descriptive elements, but also subjective and normative elements. There exist different standards and forms about the classification of the elements of constitutive requirements. This paper classifies them into three types: external subjective elements, descriptive normative elements, illegal type responsibility type elements. External elements mean the elements which can be recognized by the appearance and are used to explain the outer and objective aspects of behaviors. Subjective elements mean the inner and subjective aspects of behaviors. Descriptive elements mean the elements which only need the justices’ narration. Normative elements mean the elements which need to refer to the criterion by justices. Chapter 2 introduces the contents of external elements and the differences of such concepts between the
