II II Abstract In modern society by law, Lawyers status and function are more and more important. And lawyers are of great valuable to the society in constraining state power and safeguarding the clients legitimate rights. However, in recent years, lawyers were detrained, arrested or sentenced without reason in criminal cases and were alleged in civil actions because of defamation or invading someones reputation has occurred frequently. Based on this phenomenon, the Attorney law which was amended on October 28, 2007, and became effective on June 1, 2008, has endowed lawyers the professional right of immunity. This is a big progress. However, because of the Legal action concept of our country was that people unwilling to go to court. At the same time, lawyers were thought who pass off a fake as genuine, put making light of above everything else, fake a shape with inactivity to burn since the effect” , they were called “the man who like to make dispute” in our country almost comes to in thousands of years. This concept is not completely removed so far. At the same time, there are some problems still need solve because this regulation has some disappropriate places, supporting systems are not enough as well as other reasons. The professional right of lawyers which is used to protect lawyers personal rights how to implement effectively in practice is still a topic which is worth exploring. The author begins with analyzing the concept, significance and theoretical bases of the lawyers professional right of immunity. To clear the obstacles that may exist in the process of realizing the professional privilege, through analyzing its scope of application. And then the author gives some suggestions. Lawyer’s professional right of immunity is that lawyer’s remarks, communication and behavior should not accept the law investigates when him do his duties in practice.
