第49卷第 第49卷第8期 2015年8月 武汉体育学院学报 Journal of Wuhan Institute of Physical Education Vol. 49 No. 8 Aug. 2015 城镇化进程中体育权利的保障路径 以失地农民为例 吴真文\王岐富2，吴琛\李艳翎3(1.湖南师范大学法学院，湖南长沙410012;.长沙师范学院体育系，湖南长沙410100;3.湖南师范大学体育院，湖南长沙410012) 摘要：推进城镇化是解决我国“三农”问题的重要途径，是推动区域协调发展的有力支撑，是扩大内需 和促进产业升级的重要抓手，是全面建成小康社会、加快推进社会主义现代化的重要手段。但在城镇化 过程中，失地农民的体育权利常常被忽视，作为权利的表现形式，失地农民体育权利问题已经受到了体 育界和法学界的关注。研究认为：体育权利的构成因素包括：主体因素是人，客观因素是体育活动、体育 竞赛、体育教育和体育生活等活动和过程，内容因素是资格和可能性，形式因素是社会认可和法律规定； 体育权利的存在方式包括自主处分身体的权利、参赛权和竞赛权、合理的场地使用权、紧急救助权、规则 保护权和体育自治权。体育权利是法律所赋予的、公民和组织所享有的接受体育教育、参与体育运动和 从事体育事业的各种资格和自由。分析了城镇化过程中失地农民体育权利被忽视的原因，提出了培育 体育权利保障意识、构建权利保障制度、配备健全的体育场地设施、完善体育权利保障的监督体系等保 障措施。 关键词：城镇化；失地农民；依法保障；体育权利 中图分类号：G80-05 文献标识码：A 文章编号：1000-520X(2015)08-0013-06 DOI:10.15930/j.cnki.wtxb.2015.08.002 Protection of Sports Rights in Process of Urbanization—In View of Landless Farmers WU Zhenwen1 , WANG Qifu2, WU Chen1, LI Yanlin3(1. It is powerful in pushing forward the regional coordinative development and the keys to expanding domestic demand and promoting industrial upgrading, to building a well-off society in an all-round way and to accelerating socialist modernization. However, in the process of urbanization, the sports rights of the landless farmers are often neglected. This research holds that for sports rights, the main body is people and the objective factors include sports activities, sports competitions, physical education and sports life. Their contents are qualification and possibility. They need to be recognized by the society and abide by the law.
