摘 要 网络游戏著作权有着不同于传统著作权的明显特征，决定着其在基本原则、 侵权损害赔偿额计算方式和证据规则等方面在适用时与传统著作权存在很大的 区别。虽然我国在立法上，对网络游戏著作权侵权损害赔偿制度规定得较为完善； 但是在司法实践中，却存在侵权损害赔偿额低、证据规则适用困难和案件法定赔 偿适用泛滥等问题。 通过对美国、德国和日本这三国著作权侵权损害赔偿制度中基本原则、证据 规则和侵权损害赔偿额计算方式的考察，结合对上述问题的分析，笔者认为应该 从重构网络游戏著作权侵权损害赔偿额的计算方式、完善网络游戏著作权侵权损 害赔偿的证据规则和规范网络游戏著作权侵权损害法定赔偿的适用这三个方面 来完善我国的网络游戏著作权侵权损害赔偿制度。 关键词：网络游戏；著作权侵权；基本原则；证据规则；计算方式。 I Abstract The copyrights of online games have distinct characteristics from traditional copyrights, which determine that they are quite different from traditional copyrights when applicable in terms of the principles of tort damages compensation, the method of calculating the amount of tort damages, and the rules of evidence. Although China has more comprehensive regulations on the compensation for online game copyright infringement damages in legislation, in judicial practice, there are problems such as low infringement damages compensation, difficulty in applying the rules of evidence, and flooding of statutory compensation in cases. After reviewing the basic principles, rules of evidence, and compensation calculation methods in the three countries copyright infringement damages compensation system and the analysis of the above issues, the author believes that the calculation of online game copyright infringement damage compensation should be reconstructed Ways to improve the rules of evidence for online game copyright infringement damage compensation and regulate the application of statutory compensation for online game copyright damages to improve the online game copyright infringement damage compensation system.
