童模权益的立法保护问题研究.pdfVIP

摘 要 随着社会经济的不断发展，童模的市场也在不断扩大，它在带来巨大经济价 值的同时也引发了不少法律问题。儿童权益自古是世界各国研究的热点，在不同 时期被赋予了不同的内涵，而如今童模的权益更是当前各国学者关注的问题。童 模权益的保护程度不仅反映出了一个国家法治发展的进度，同时也反映出了人民 法治思维的高低。笔者从当前热议的“妞妞”事件入手，对当前童模市场存在的 问题进行科学检视，分析了童模的法律性质，对保护童模的合法权益，完善童模 行业的相关立法具有一定的积极意义。 我国目前并没有完善的法律规范来应对这类事件，在实践中也是求助无门的 状态，现有的法律主要关注的是童模作为儿童的这一重身份，而忽视了他们能创 造巨大经济价值的模特这一职业身份。 笔者通过对英美法系和大陆法系国家现有的童模法律保护措施进行分析，结 合我国存在的问题，提出了符合我国国情的解决措施。对于这类事件，我们最主 要的就是从根源上解决，首先是有法可依，要制定专门的法律来严格限制童模行 业，不能任由其肆意发展，要增设专门的部门来处理这类事件。光靠法律还不够， 还需要学校以及社会各界的配合，让孩子们在法律保护的天空下自由飞翔。 关键词：童模；儿童权益；法律保护；立法 I Abstract With the continuous development of social economy, the market of childrens models is also expanding, which brings great economic value but also causes many legal problems. Since ancient times,the rights and interests of children have been the focus of research in various countries in the world, and have been endowed with different connotations in different periods. The degree of protection of childrens model rights not only reflects the progress of a countrys legal development, but also reflects the level of peoples legal thinking. Starting from the hot topic of niuniu incident, the author scientifically examines the problems existing in the current childrens model market, and analyzes the legal nature of childrens model,which has certain positive significance for protecting the legitimate rights and interests of childrens model and improving the relevant legislation of the childrens model industry. At present, there is no perfect legal standard in China to deal with such events, and in practice, there is no recourse. The existing laws mainly focus on the heavy identity of childrens models, but ignore the professional identity of models who can creategreat economicvalue.
