PAGE PAGE 2 世茂云锦玉海园工程项目合同管理分析 Contract Management Analysis of Shimao Yunjin Yuhai Park Project 摘 要 随着我国各地区基础设施建设的进一步完善,建筑行业经过多年的积累,施工工艺和建设水平也在精益求精地发展着,但是,包括合同管理在内的各方面管理水平仍处于相对落后的阶段,不仅无法跟上实际施工的步伐,无法将施工效率最大化,而且会带来各种各样的问题,比如经济纠纷,责任纠纷等,无法保证公平的同时又对成本、工期等造成不必要的损耗,而这些都是企业提升自身水平所必须面对的问题。尤其是这些管理问题中的合同管理问题,因其在工程项目管理中占据着特殊且重要的地位,解决相关问题所需的成本也相对更少,所以解决合同管理方面存在的问题将成为一个企业快速提升实力的简单而且有效地途径,同时也对改善建筑行业发展环境有非常大的作用。 本文将从合同管理方面入手,以“世茂云锦玉海园工程项目”为例,从合同订立,签订,履行,等阶段中发生的事件以及最终结果,反映出目前工程项目合同管理的各种常见问题,并提出我个人设想的解决方案,希望通过本文,为日后提升企业自身水平,改善建筑行业发展环境带来良好影响。 关键词:合同签订,合同履行,合同纠纷,合同变更,合同索赔 Abstract Along with the develop of infrastructure in China, Construction industry has been accumulation for years, construction technology and level are keeping develop,too.However,including contract management,all aspects of management level is still relatively backward stage. Not only cant keep up with the actual construction progress, construction efficiency cannot be maximized,but also brings a lot of problem,such as economic and responsibility disputes.It can not keep fair and cause unnecessary wear and tear.And these,are the problem of the enterprises improve their own level need to face. Especially one of them,the contract management issues.Because of it is in the project management occupies a special and important position and the cost of solving problem is less then the others.So,it will be a simple and effective way that the enterprises rapidly enhance the strength.It will be a huge role to improving the development environment of the construction industry at the same time. In this passage,I will start from contract management,make the Shimao yunjin yuhai yuan project as an example. Reflect the current project contract management of various common problems by the events occurring during the contract formation, execution, performance, etc. and the final result.And come up with my own solution.I hope that the enterprises rapidly enhance the level and bring some good effect for the construction indust
