摘 要 近年来，滥用诉权行为在现实的诉讼活动中大量存在，且有恶化之势，已成 为一种社会危害。立法空缺的“先天不足”是导致此类案件逐年上升的主要原因。 民事诉权的滥用是当事人利用诉讼为自己获取不正当利益的诉讼行为。由于民事 诉权的滥用往往是恶意当事人牺牲对方的利益来换取自己的不正当利益，法院若 处理不当不仅会侵害到当事人的个人利益，同时会影响司法的权威和声誉，因此 杜绝民事诉权的滥用势在必行。笔者以为，应当吸取国外的先进有效的经验，建 立和完善防范滥用民事诉权行为的对策与措施，树立法律的权威,以维持良好的社 会秩序。 滥用民事诉权是诉讼当事人违背诚实信用原则，基于不正当目的，故意地、 非善意地、非公正地行使与诉讼目的不一致的诉讼权利而造成对方当事人或他人、 国家、集体利益损害及或以诉讼这一合法形式获得非法利益的行为。本文从产生 民事诉权的滥用的原因、特征入手，在阐明民事诉权滥用危害的基础上提出对策， 对杜绝民事诉权的滥用应采取的措施提出了自己的观点，以期有助于这一难题的 解决。 关键词：民事诉权 诉权滥用 诚实信用 司法权威 1 Abstract In recent years, there exists rights abuse in a great quantity, having worsening in telling the right behavior legal action activity in reality. Congenital deficiency of Legislation vacant position has already become the main cause of the law case here rising year by year. The abuse is a kind of action that the interested party makes use of legal action to be that self gains illegitimate benefit action at law. Telling the right abusing since civil sometimes is that the evil intention interested party sacrifices the illegitimate benefit coming to get self in return the other partys benefit, the court is able to encroach on the individual benefit arriving at an interested party not only if being not handled properly, at the same time, is able to affect judicial authority and reputation , completely eradicate therefore civil abusing telling right is imperative. The author believes advancement ought to absorb abroad experience having effect ,and building-up improving and perfecting keeping watch the authority who abuses civil the countermeasure appealing to weigh up behavior and measure , sets up a law, to maintain fine social order.
