摘要 随着我国城市化进程的逐步加快，流动摊贩数量越来越多，所引起的社会问题也日趋 复杂，城管执法人员与流动摊贩之间的暴力事件更是引起了政府的高度重视和社会的广泛 关注。 本文主要运用文献资料分析、走访调查以及对比分析的方法，对城市流动摊贩的定义、 特征、类型及存在的原因进行了分析，回顾了我国城市流动摊贩及其管理历史，并且描述 了其现实状况，引出了城管执法人员与流动摊贩之间的矛盾及其成因的探讨。同时运用城 市管理的相关理论、外部性理论、博弈论和民生理念等去分析探讨管理过程中遇到的困境 及其原因，在此基础上根据新公共管理视域下的现代城市管理要求，提出相关的建议及对 策，试图寻找在城市化过程中城市市容与流动摊贩权利之间的一个平衡点，以缓解城管执 法人员与城市流动摊贩之间的矛盾，为相关政府部门制定合理的政策提供参考，从而促进 和谐城市以及和谐社会的构建。 关键词：流动摊贩 城管执法人员 生存权利 城市管理 I Abstract As the gradual acceleration of China’s urbanization process, the number of the peddlers is increasing quickly. This has caused more and more complicated social problems, especially the violence conflicts between the officers of urban management law enforcement and the peddlers, which has aroused the concerns from the government and the society. Based on the investigation and analysis of document data, this paper firstly analyzes the definition, characteristics, type and the reasons for the existence of the peddlers, secondly describes the peddlers’ past and present situations and the government ’s policy on them, then analyzes and discusses the contradiction and its reasons between the officers of urban management law enforcement and peddlers. At the same time, by applying city management theory, the external theory, the game theory and the concept of peoples livelihood, this paper also studies the difficulties and its reasons during the management of peddlers. On this basis, according to the new point of neo-public administration, this paper gives advices for the management of peddlers, and tries to find the balance between the peddlers’ rights and the urban environmental management during the China’s urb
