摘 要 笔者认为世贸组织(实体)法的基本原则是国际贸易自由原则 和国际贸易公平原则。虽然世贸组织协定并没有明文规定规范化的 基本原则，但是本文依据详尽、系统的法的基本原则理论，分析证 明了其他原则在内涵和外延上都不完全具备基本原则的性质，并论 证了国际贸易自由原则和国际贸易公平原则承载着世贸组织(实体) 法的基本价值，是世贸组织协定建立的国际社会经贸秩序中两大集 团对立统一的利益主张的表现。因此，世贸组织(实体)法的基本 原则也只能是国际贸易自由原则和国际贸易公平原则。 对世贸组织协定的研究是国际经济法学的一个专题内容，系统、 科学、深刻的世贸组织基本原则理论，将为我国在全面深刻地研究 世贸组织法提供坚实的理论基础。而对这两个基本原则及其本质的 正确认识，有助于我们全面深刻地理解世贸组织(实体)法规则， 把握世贸组织(实体)法的发展运动，对我国在加入世贸组织后多 边贸易体系中履行义务，行使权利，谋求发展，以及在新一轮多边 贸易谈判中制定新规则，都具有重大的指导意义。 关键词：世界贸易组织法 法的基本原则 法律秩序 国家利益 Abstract Theauthor the arethe considersfundamentalofWTO principles Freedom Fairness andthe ofInternationalTrade． Principle Principle haven’t can WTO awrittenfundamental arrive A／though principle，we atthesetwo abovethe one carl points by followingway：Onhand，we exclude thefundamental to other as accordingmy principles principle and offundamentalof the law；On thorough theory principle systematic other Call thatthesetwofundamentalcontain hand，we prove principles values and arethe ofthe the ofWTo fundamental they representations fromthetwointerest ofthe interestclaims
