西南科技大学硕士研究生学位论文第西南科技大学硕士研究生学位论文第 II 页 Abstract In recent years, there is a more and more violent increasing trend of relevant prostitution cases. The boundary between the crime of organizing prostitution and the crime of assistance in organizing prostitution still remains ambiguous. The dispute and divergent ideas long exited in the academic circle bring certain difficulty to the judicial determination and causes different treatments toward the cases with the same circumstance. The controversial focus point is that the behavior of Zhang mou and Chen mou constitute the crime of organizing prostitution or the crime of assisting in organizing prostitution charges .This article starts with the constitutive requirements of the crimes of organizing prostitution and assisting in organizing prostitution charges ,analyzing the subjective aspects and objective aspects of the crime of organizing prostitution along with the definition and connotation of “organization” on the one hand ；the subjective and objective aspects of the crime of assisting in organizing prostitution along with the essential relation between the subjective and objective on another hand 。Analyze the recognized boundary between the crimes of organizing prostitution and assisting in organizing prostitution ，then compare the former with the later ,acquire the key factors to distinct the two crimes through the sense of organization and helpfulness by comparing the two crimes and combining the theory wi th the practice and specific case.
