浅议预算法律缺陷与完善 　　摘要：本文从预算、预算法律定义入手，阐述了我国《预算法》自1995年实施以来，对规范预算监督和强化预算分配和监督管理，促进经济和社会健康发展重要作用；指出十几年来，由于环境变化，出现新情况，面临新问题，《预算法》存在不足和缺陷及表现，为此笔者提出了五点完善建议： 　　①明确《预算法》的内涵，突出《预算法》的权威性和严肃性，坚持有法可依； 　　②严格《预算法》的程序，规范实施，强化预算审批监督； 　　③强化《预算法》的监督、审批，坚持法律面前平等； 　　④细化预算执行法律后果及责任，严格认真履行职责； 　　⑤规范预算调整审批程序，加强预算法律效力。 　　关键词：预算 法律 缺陷 完善 　　 　　Discusses the budget law flaw and the consummation shallowly 　　Jiang Hui 　　Abstract:This article from the budget,budget law definition obtaining,elaborated our country “Budget mehtod” has implemented since 1995,supervises and strengthens the allotment and the management by supervision to the standard budget,the promotion economy and the social healthy development vital role;Pointed out for several years,as a result of the environmental variation,have the new situation,faced with the new question,“Budget mehtod” have the insufficiency and the flaw and the performance,proposed for this author five consummate suggested: 　　①Is clear about “Budget mehtod” connotation,prominent “Budget mehtod” the authority and the solemnity,persisted has legal support; 　　②Strict “Budget mehtod” procedure,standard implementation,strengthened budget examination and approval surveillance; 　　③Strengthens “Budget mehtod” surveillance,examination and approval,in front of insistence law equality; 　　④The refinement budget implementation law consequence and the responsibility,earnestly fulfill the responsibility strictly; 　　⑤Standard budget adjustment examination and approval procedure,enhancement budget legal effect. 　　Keywords:BudgetLawFlawConsummation 　　【中图分类号】F811.3【文献标识码】B 【文章编号】1009-9646(2008)09-0109-03 　　 　　预算是经法定程序批准的国家和地方各级政府及企事业单位对未来在一定时期的收入支出的预计方案，包括国家预算和单位预算，是政府凭借国家权力对社会财富的征收及再分配，是社会各阶级、各层面利益的调整。预算法是调整预算关系的法律规范的总称，预算法律是对预算进行规范和调整的法律，它要求各级政府行使权力和使用财政资源必须严格按照法律批准的项目、程序和数额执行。 　　《中华人民共和国预算法》(以下简称《预算法》)自1995年实施以来，对于规范预算监督和预算行为，加强我国的预算管理，强化预算分配和监督，促进经济和社会健康发展发挥了重要作用，对我国预算监督管理步入规范化、法制化轨道起到了积极作用。十几年来，我国从开始探索建立社会主义市场经济体制，发展到加快和完善市场经济建设的阶段，随着经济全球化进程的加快，出现了许多新情况，面临许
