this matter and promote the early perfection of the laws of anti-employment discrimination of our country.
The paper consists of four sections.
The first section is on the definition of employment discrimination, including the meanings and cognizance standards of employment discrimination. On the base of the corresponding foundation theory, the section defines the meanings and cognizance standards of employment discrimination, and analyzes further the representations of employment discrimination in our Country.
The second section is on the theoretic basis of employment discrimination. The corresponding theory evidences related to anti-employment discrimination lie in the fields of economics, sociology and right of labor, which justifies the realism, rationality and necessity of anti-employment discrimination.
The third section is to study the law system of anti-employment discrimination in American as well as its apocalypse to our country. This section firstly specifies the legislation status quo and the practical consequence of American anti - employment discrimination, and further concludes some apocalypses to our country on the basis of the law system of anti-employment discrimination in America, and consequently put forward to some suggestion on the legal construction of anti-employment discrimination in China.
The fourth section is to analyze the measures to perfect the laws on anti
- employment discrimination in China, which is the final purpose of this paper. In the author’s opinion, the law system of anti - employment discrimination should be established and improved, which suits the situation of our country. At present, the most feasible measure is, in process of implementing the Employment Promotion Act, to further perfect relative contents of anti-employment discrimination through the form of judicatory interpretation promulgated by the Supreme Court, practically improving the operability and implementing the law of anti-employment discrimination in real
