摘 要 随着中国经济的高速增长及城市化进程的加快，对农村土地的征用规模也在 不断扩大，大量的农民因征地而成为失地农民。在征地制度尚不完善的情况下， 失地农民的合法权 益未能得到有效保障，致使他们 种田无地、就业无岗、社保无 门，生活在农村与城市的边缘，成为了中国又一新的弱势群体。失地农民问题不 仅影响到社会稳定、农村发展，不利于中国城市化的进一步推进， 也严重制约了 整个国家现代化建设的进程 。因此，妥善解决失地农民问题既是推进城市化进程 的客观需要，也是政府职责的内在要求，更是构建和谐社会的现实诉求。 中国的城市化是把双刃剑，既加快了中国的现代化进程，也导致了失地农民 问题的日益激化。 失地农民问题的产生有征地补偿标准过低、就业安置不力和社 会保障不完善等表 层原因，也有中国农村土地产权的主体模糊、公共利益界定不 清等深层原因。归根结底，失地农民权益受损的原因主要在于国家相关政策制定 的不完善以及政策执行的不到位。因此，有效维护失地农民的合法权益，还有赖 于政府制定并完善相关政策。 本文以中国的城市化进程为背景，导出失地农民问题的产生，分析了失地农 民的权益受损状况，从土地征用的制度安排以及运作模式的维度探讨了失地农民 问题产生的根源。并在借鉴国外经验的基础上，从政策支持的角度，就如何保护 失地农民的合法权益，提出了政府在完善土地征用政策、健全社会保障制度、加 大就业安置力度、增加相应的财政投入等方面的政策建议。 关键词：城市化；失地农民；权益受损；政策支持 Abstract Along with the chinese economical high speed growth and the accelerating of urbanizative process, land expropriative scale also unceasingly is increasing. so the massive farmers became Land- losing farmers.In drafted the land expropriative police still in the imperfect situation, Land- losing farmers legitimate rights and interests not to be able to obtain the effective safeguard, caused them to farm does not have, the employment does not have the hillock, society guarantees without the gate, lived in the countryside and the city edge, has become Chinese new Vulnerable Groups.
